PHC issues notice on petition seeking removal of PM Mulk

PESHAWAR: The Peshawar High Court on Tuesday issued notice to the federal authorities on a petition seeking removal of caretaker prime minister Justice (retd) Nasirul Mulk.

A bench of the high court directed the official respondents to submit comments by August 7.

Petitioner Shahid Orakzai, approached the PHC, claiming that the caretaker prime minister, during his tenure as the Peshawar High Court judge, had granted bail to a ‘hired assassin’ named Bahadur Khan in 1998 involved in the murder of his (petitioner’s) brother Major Kahlid Saeed Orakzai.

The petitioner said Mr Mulk dismissed his petition seeking cancellation of bail against the accused in 2002.

The petitioner prayed the high court to declare that the respondent (retired Justice Nasirul Mulk) had betrayed the Code of Criminal Procedure by granting bail to a person who was described as a hired assassin by a full bench of the Supreme Court.

Orakzai urged the court to remove the respondent from the office of the prime minister. He contended that to be a prime minister of Pakistan, under Article 62 of the Constitution, a person shall be sagacious, righteous, non-profligate and honest.

The petitioner stated that his brother was attacked on Sept 4, 1997 and he expired at CMH Rawalpindi on Sept 12, 1997.
